Welcome to The Working Creator. These Terms of Service ("Terms") are an agreement between you and The Working Creator ("we," "us," or "our"). They govern your use of theworkingcreator.com and everything we offer through it — our videos, newsletter, blueprints, challenge sheets, workbooks, audiobooks, courses, merchandise, any mobile app we release, and any other materials, products, and services (together, the "Service" and the "Content"). By using the Service, subscribing to our newsletter, downloading a resource, or buying a product, you agree to these Terms and to our Disclaimer and Privacy Policy. If you don't agree, please don't use the Service.
These Terms include provisions that affect your legal rights — an assumption of risk, a limitation of our liability, an indemnification obligation, and a section on dispute resolution. Please read them in full.
1. Who may use the Service
The Service is intended for adults. By using it, you confirm that you are at least 18 years old (or the age of majority where you live) and able to enter into a binding agreement. Our Content is written for a general adult audience and is not directed to children under 16.
2. Educational purpose only — no advisory relationship
Everything we publish is for general educational and informational purposes only. Our Content — including any examples, walkthroughs, checklists, scripts, gear suggestions, frameworks, and stories — is illustrative. It is not, and is not a substitute for, legal, financial, tax, business, medical, or other professional advice, and using it does not create any professional, advisory, coaching, employment, or fiduciary relationship between you and The Working Creator.
Every creator, topic, and situation is different. You are solely responsible for deciding whether any of our Content suits your circumstances and for how you choose to apply it. Before acting on anything you read, watch, or hear from us — particularly anything involving money, contracts, taxes, sponsorships, copyright, or the rules of a platform you publish on — consult a qualified professional who can advise you on your own situation.
3. No guarantee of results
We do not promise or guarantee any particular result. Any reference to audience growth, subscribers, views, monetization, sponsorship, or income is illustrative and is not a guarantee of any outcome or of any amount of money. What happens to your channel depends on many factors outside our control — your topic, your effort, your consistency, your audience, and the decisions of platforms we don't own or influence. Results differ from person to person, and many people who start a channel earn nothing at all. Any testimonials or examples reflect individual experiences and are not typical.
4. Your responsibilities and assumption of risk
You agree to use the Service lawfully and responsibly, and you accept that you are fully responsible for your own decisions and actions, including any decision to publish, spend money, buy equipment, or change your working life based on something you learned from us. You understand and agree that:
- Anything we share is an example to learn from, not an instruction to follow exactly, and outcomes vary with your own execution and circumstances;
- You are responsible for complying with the terms, policies, and community rules of any platform you publish on, and for the content you publish, including any rights you need to use music, footage, images, or other material;
- You will use your own judgment — and, where appropriate, seek qualified professional advice — before making financial or legal decisions; and
- You knowingly assume all risks associated with applying our Content, and you are responsible for the consequences of your own conduct.
5. Acceptable use
You agree not to misuse the Service. In particular, you may not: use the Service in any unlawful way or for any unlawful purpose; interfere with or disrupt the Service or its security; attempt to gain unauthorized access to any part of it; scrape, harvest, or collect information about others; or use the Service to harass, abuse, or harm anyone.
6. Intellectual property and your license
All Content is owned by The Working Creator (or used with permission) and is protected by copyright, trademark, and other laws. The The Working Creator name, logo, and brand are our trademarks and may not be used without our written permission.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use our Content for your own personal, non-commercial use and your own creative development. You may absolutely use what you learn in your own channel and your own work. This license does not allow you to copy, reproduce, republish, redistribute, sell, license, or publicly share our Content — including our blueprints, challenge sheets, workbooks, audiobooks, and course materials — or to use them to build a competing product, training, membership, or coaching offering, or to present them as your own. Where we specifically offer something as a shareable download or a template, you may use it as described on that resource.
7. Purchases and payments
Some parts of the Service are paid — for example, digital products, workbooks, audiobooks, courses, merchandise, and any premium subscription we offer. Descriptions and current pricing are shown at the point of purchase and may change over time. Payments are handled by third-party providers, and by buying from us you also agree to their terms. You are responsible for giving accurate payment and delivery information and for any applicable taxes.
Any subscription renews automatically for the interval you chose until you cancel. You can cancel at any time to stop future renewals; cancellation takes effect at the end of the current billing period. Purchases made through a third-party platform or app store are also subject to that platform's billing and refund rules. Except where required by law or stated at checkout, digital products and completed purchases are non-refundable. Physical merchandise is fulfilled by our merchandise partner, and its return and shipping policies apply. Any specific refund or guarantee we offer will be described on the relevant product page and forms part of these Terms.
8. Newsletter and communications
If you subscribe, you agree to receive our newsletter and related emails, and you can unsubscribe at any time using the link in any message. How we handle your information is described in our Privacy Policy.
9. Submissions and feedback
If you send us questions, ideas, suggestions, or other feedback, you grant us a non-exclusive, royalty-free, worldwide license to use it to operate and improve the Service, with no obligation to you. Please don't send us confidential information you don't want us to use.
10. Affiliate links and third-party content
Some Content may contain affiliate links or sponsored references, as described in our Disclaimer. The Service may also link to third-party websites, products, or resources we don't control. We are not responsible for the accuracy, content, or practices of any third party, and a link is not an endorsement. Your dealings with any third party are solely between you and them.
11. Disclaimer of warranties
The Service and all Content are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. While we work to keep our Content accurate and current, it may contain errors or omissions and may go out of date — platforms, tools, and prices change. We don't warrant that the Service will be uninterrupted, secure, or error-free.
12. Limitation of liability
To the fullest extent permitted by law, The Working Creator and its owner, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, income, data, goodwill, reputation, or business, arising out of or relating to your use of — or inability to use — the Service or Content, or your reliance on any Content, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims relating to the Service or Content will not exceed the greater of (a) the total amount you paid us, if any, for the specific product or subscription giving rise to the claim in the twelve (12) months before the claim, or (b) fifty U.S. dollars. Some jurisdictions don't allow certain limitations, so parts of the above may not apply to you; in that case our liability is limited to the smallest amount permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless The Working Creator and its owner, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Service, your violation of these Terms, your violation of any law or the rights of a third party, or your own decisions and actions in applying our Content — including anything you publish.
14. Changes to the Service and to these Terms
We may add, change, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; when we do, we'll change the "Last updated" date above and post the revised Terms on this page. Continuing to use the Service after changes take effect means you accept the updated Terms.
15. Dispute resolution and governing law
Let's talk first. If you have a concern, email us at info@theworkingcreator.com so we can try to sort it out informally. Most things get resolved quickly this way.
These Terms are governed by the laws of the United States and of the state in which The Working Creator is established, without regard to conflict-of-laws rules. You agree that any dispute not resolved informally will be brought exclusively in the state or federal courts serving that location, and you consent to the personal jurisdiction of those courts — except that either party may bring a claim in small-claims court where eligible.
Any claim relating to the Service or Content must be brought within one (1) year after it arises, to the extent permitted by law. To the extent permitted by law, you and we agree that any dispute will be resolved on an individual basis, and that you and we waive any right to take part in a class or representative action.
16. General
These Terms, together with our Disclaimer and Privacy Policy, are the entire agreement between you and The Working Creator regarding the Service, and they replace any earlier agreements. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent, and we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship between us.
